Aeviro Terms & Conditions (2025 Edition)

1. Acceptance of Terms

By accessing, browsing, or using the Aeviro website, mobile site, or related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law to use Aeviro. By creating an account, you represent that all information you provide is accurate and complete.

3. Account Registration and Security

• Provide true, current, and complete information.
• Maintain the confidentiality of your login credentials.
• Notify Aeviro promptly of any unauthorized access or breach.

You are responsible for all activities under your account.

4. Our Services

Aeviro provides an online platform that allows users to order groceries and related products from participating fulfillment partners. Aeviro facilitates the transaction and delivery but does not manufacture or produce the goods. We may update, modify, suspend, or discontinue parts of the Services at any time without prior notice.

5. Orders and Payments

• Orders are subject to product availability, service area, and delivery windows.
• Prices may change without notice and may include applicable taxes and fees.
• Payments are processed securely by Stripe; Aeviro does not store full card numbers.
• Once an order is confirmed, cancellations may not be possible depending on order stage.

If a charge is made in error, contact support@aeviro.ai within 48 hours for assistance.

You are responsible for applicable taxes where not collected at checkout. We may suspend accounts for suspected fraud or abusive chargebacks and seek recovery of related costs where permitted by law.

6. Delivery and Fulfillment

Deliveries are made through Aeviro’s partner network and third-party providers (including integrations such as Uber Direct). Estimated delivery times are approximations and may vary due to weather, traffic, demand, or other factors. You agree to provide accurate delivery instructions, be available to receive the order, and promptly report any issues.

Aeviro is not responsible for failed deliveries due to incorrect information or unavailability.

7. Service Area & Address Requirements

Service is currently limited to Jersey City, New Jersey. Orders must use a valid service address within authorized ZIP codes (07302, 07304, 07306, 07307, 07310, 07311). A valid phone number is required for delivery coordination. We may reject, cancel, or refund orders placed outside the service area or without required information.

8. Product Information and Pricing

We strive to provide accurate product descriptions and pricing; however, errors may occur. If a pricing or listing error is identified after purchase, we reserve the right to correct it and, if necessary, cancel or refund the order.

9. Refunds and Returns

Due to the perishable nature of groceries, all sales are generally final once delivered. Refunds or replacements may be provided on a case-by-case basis for damaged/missing items, incorrect orders, or unsatisfactory quality (as determined at Aeviro’s discretion). Please email support@aeviro.ai within 24 hours of delivery.

10. Order Tracking & Security

For security and privacy, order tracking links use Aeviro order IDs rather than third-party payment identifiers. Do not share tracking links publicly. If you suspect unauthorized access, notify us immediately.

11. Communications and Notifications

• WhatsApp for support and order updates.
• Email for receipts, operational notices, and (optional) promotions.

You may opt out of promotional messages at any time (e.g., via unsubscribe links or messaging "STOP").

By providing your phone number, you consent to receive operational messages (e.g., order updates) via WhatsApp (and, if used, SMS). Message and data rates may apply. You can opt out at any time by replying "STOP" or contacting support. Consent is not a condition of purchase.

12. AI Features & User Content

If you use AI features (such as chat, speech-to-text, or text-to-speech), you grant Aeviro a limited license to process your prompts, messages, and audio for the purpose of providing the feature. These features are powered by third-party AI providers (e.g., OpenAI). Do not submit content that is unlawful, harmful, or infringes others’ rights. We may moderate or disable features at our discretion. For data practices, see our Privacy Policy.

AI-generated content may be inaccurate or incomplete and is provided for convenience only. Do not rely on AI outputs for medical, legal, financial, or safety-critical decisions.

13. Intellectual Property

All content, trademarks, design, and software on the platform are the property of Vedhas Inc. d/b/a Aeviro or its licensors. You may not copy, distribute, or modify any part of the Services without prior written permission.

14. Prohibited Uses

• Use the Services for unlawful purposes.
• Attempt to gain unauthorized access to systems or data.
• Resell or exploit the Services for commercial gain without permission.
• Interfere with or disrupt platform operation.
• Misuse AI features (e.g., submitting illegal content or attempting to bypass safeguards).

15. Third-Party Links and Integrations

The Services may include links or integrations with third-party services (e.g., Stripe, WhatsApp, delivery networks like Uber Direct, and AI providers). Those services are subject to their own terms and privacy policies, and Aeviro is not responsible for their content or practices.

16. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, Aeviro and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages; loss of data, profits, or business; or issues arising from third-party delivery or payment providers. Total liability under any claim shall not exceed the amount paid by you for the specific order involved.

18. Indemnification

You agree to indemnify and hold harmless Aeviro, its affiliates, officers, employees, and agents from any claim, damage, liability, or loss arising out of your use of the Services or violation of these Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, USA. By using Aeviro, you waive any right to participate in class or representative actions.

20. Termination

Aeviro may suspend or terminate your access at any time for any reason, including violation of these Terms. Provisions related to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

21. Changes to Terms

We may update these Terms periodically. Changes take effect when posted at https://www.aeviro.ai/terms. Your continued use of the Services after updates signifies acceptance of the revised Terms.

22. General Provisions

• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, labor disputes, supply chain disruptions, or service outages.
• Severability: If any provision is held invalid, the remaining provisions remain in full force and effect.
• Waiver: A failure to enforce any provision is not a waiver of the right to enforce it later.
• Assignment: You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
